Nature of this service

NameThat is a private, non-commercial prototype project. It generates no revenue — no advertising, no paid features, no sponsorship.

The obligation to provide an imprint under § 5 DDG applies to digital services offered “on a business basis, usually for payment”. As long as this service is operated purely privately and with no intention to earn revenue, that obligation is arguable in the individual case; this imprint is provided as a precaution. As soon as the service generates revenue or becomes commercial, a complete imprint is mandatory — further details may then be required (VAT ID, commercial register, competent supervisory authority, professional title).

Consumer dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). Since NameThat is not a paid offering, there is no consumer contract within the meaning of the VSBG.

Liability for content

As a service provider we are responsible for our own content on these pages under the general laws (§ 7 (1) DDG). However, under §§ 8 to 10 DDG we are not obliged as a service provider to monitor transmitted or stored third-party information or to investigate circumstances that indicate unlawful activity. Obligations to remove or block the use of information under the general laws remain unaffected. Upon becoming aware of any such infringements, we will remove that content promptly.

Liability for links

Our service contains links to external third-party websites over whose content we have no control. The respective provider or operator is always responsible for the content of the linked pages. Upon becoming aware of legal infringements, we will remove such links promptly.

Copyright and third-party content

The source code and game concept of NameThat are protected by the operator’s copyright. In addition, NameThat embeds third-party content:

• Music: 30-second preview clips via the public Deezer API. The rights to the musical works and recordings belong to the respective rights holders.
• Photos of people (“NameThat Person” category): from Wikimedia Commons, each under a free licence (CC0, CC BY, CC BY-SA or public domain). Author and licence are shown on each image via the “i” button.
• Silhouettes (“NameThat Size” category): our own artwork, created for this project.

Should you nevertheless become aware of a copyright infringement, please let us know. Upon becoming aware of legal infringements, we will remove the content concerned promptly.
